Terms of Service

These Terms of Service ("Terms") govern your use of the roofing estimate request form and related messaging operated by Voyar Digital, a sole proprietorship operated by Mathew Dicasagrande in North Carolina. By submitting a request or replying to our messages, you agree to these Terms. If you do not agree, do not submit a request.

Calls to a roofing company that uses Voyar may be answered by an AI receptionist and are recorded and transcribed, as described in our Privacy Policy.

1. What this service is — and what it isn't

Voyar Digital operates lead intake and appointment messaging on behalf of independent roofing contractors. When you submit an estimate request, we pass it to the contractor serving your area and help coordinate an inspection.

Voyar Digital does not perform roofing work, does not employ the contractors, does not supervise or inspect their work, and is not a party to any agreement you enter into with a contractor. Any contract for work, its price, scope, schedule, warranty and performance are strictly between you and that contractor.

2. Eligibility

You must be at least 18 years old and be the owner of the property, or authorized to request work on it, to submit a request.

3. SMS Terms

By providing your phone number and checking the consent box on our form, you agree to receive recurring automated text messages from Voyar Digital, sent on behalf of the roofing company you contacted, about your request. The texts come from that roofing company and say so (for example, "this is Sample Roofing Co."); Voyar Digital sends them through its platform. Your consent covers texts about your request from that roofing company only and is not shared with any third party.

• What you'll receive: a reply to your request, appointment scheduling, inspection confirmations, and follow-ups if the roofing company hasn't heard back from you.
• Only called? If you phone a roofing company that uses Voyar and the call is missed, you may get a single text back about that call. If you book an inspection by phone, you'll get texts about that appointment (a confirmation and reminders). Reply STOP anytime. Other follow-ups go only to people who agreed to texts on a request form.
• Message frequency varies with your request and your replies, typically fewer than 10 messages per request.
• Message and data rates may apply. Your mobile carrier may charge you for sending or receiving messages.
• To opt out, reply STOP to any message. You'll get one confirmation and no further messages.
• For help, reply HELP, or email mathewdicasa@voyardigital.com.
• Carriers are not liable for delayed or undelivered messages.
• Consent to receive text messages is not a condition of any purchase.

4. Your responsibilities

You agree that the phone number you give is your own or one you're authorized to receive messages at, that the property and work details you provide are accurate to the best of your knowledge, and that you will notify us if your number changes. You agree not to use the form to submit false requests or another person's information.

5. Disclaimer of warranties

The service is provided "as is" and "as available." To the fullest extent permitted by law, Voyar Digital disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, that messages will be delivered, or that any contractor will contact you, provide an estimate, be available, be properly licensed or insured, or perform work to any standard. We do not screen, endorse or guarantee any contractor.

6. Limitation of liability

To the fullest extent permitted by law, Voyar Digital and its owner will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, property damage, or personal injury, arising out of or relating to the service or to any work performed or not performed by a contractor — whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.

Our total aggregate liability for any claim relating to the service will not exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing here limits liability that cannot be limited under applicable law.

7. Indemnification

You agree to indemnify and hold harmless Voyar Digital and its owner from any claim, demand, loss or expense (including reasonable attorneys' fees) arising out of your use of the service, your breach of these Terms, information you submitted that was false or that you were not authorized to submit, or any dispute between you and a contractor.

8. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Pitt County, North Carolina, and you consent to the personal jurisdiction of those courts.

Before filing anything, you agree to contact us at the email below and give us 30 days to resolve the issue informally.

9. Privacy

Our handling of the information you provide is described in our Privacy Policy, which is incorporated into these Terms.

10. Changes, severability, entire agreement

We may update these Terms; the date at the top reflects the most recent change, and continuing to use the service after a change means you accept it. If any provision is held unenforceable, the rest stays in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and Voyar Digital regarding the service.
